THE SOKOTO STATE HIGHER COURT JUDGE, JUSTICE MOHAMMED MOHAMMED STROKE OUT THE EFCC CASE IE SEN. UMAR TAFIDAN KABI Vs FEDERAL GOVERNMENT
The Sokoto State Higher Court judge, Justice Mohammed Mohammed today Monday March 21st stroke out the EFCC case ie Sen Umar Tafida Vs Federal Government and equally discharge Sen Tafida. In his ruling he said the case has not been initiated on the due process of law because the case is purely civil transactions based on the business contract entered by Sokoto State Government and hijrah Textiles via Memorandum of Understanding signed by two mutual partners and its clearly based on the business contract signed by the partners who have joint responsibilities of providing of funds for working capital and as may be required for the operations of the company based on the ratio of the shareholdings or ownership structure.The money paid to Hijrah Textiles is for the purchase of 40% shares or equity share holding. In case of any disagreement between the shareholders the Memorandum of Understanding has defined steps to address any disagreement and the Memorandum of Understanding is still open. He said EFCC has no business in delving in civil cases of this nature. He also advises EFCC to critically examine all the petitions send to them to see which ones are within their jurisdiction and to be bold enough to inform any petitioner if his petition does not fall within their jurisdiction no matter how beautifully the petition is crafted. The judge said that the police and or any government investigative agency like EFCC has no right to dictitate on what the terms of a business contract will be between business partners and added that
even a court of law doesn't have that right.
